BEDA LEISURE LIMITED TERMS & CONDITIONS OF USE FOR LIVELOTTO®

 1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for the lottery draw (the “LiveLotto®”) and its associated gameplay.  LiveLotto® is promoted and managed by Beda Leisure Limited.  LiveLotto® is a brand owned by Beda Leisure Limited who are responsible for all aspects of the management of LiveLotto®

The correspondence and registered head office address for Beda Leisure Limited is Technology Centre, Marsh Lane, Preston, PR1 8UQ UK.  Beda Leisure Limited is a limited company registered in England and Wales issue number 8666765.

1.2 Beda Leisure Limited are External Lottery Manager’s and are licensed and regulated by the UK Gambling Commission (www.gamblingcommission.gov.uk) which has issued a license number of  000-042416-R-322208-001.

1.3 Beda Leisure Limited manage society based lotteries for various charities as listed on our webpage (www.livelotto.co.uk/charities) and reserve the right to alter these periodically to ensure that the money raised for good causes is diversified and assists as many causes as possible.  Each of the society lotteries are already regulated by the UK Gambling Commission and it will be clear to the player before purchase on which Society they are purchasing tickets for.

1.4 20% of all proceeds of each lottery belong to the society on whose behalf we operate.  These funds are held in separate client accounts and are protected under UK law from Beda Leisure’s insolvency.

1.5 All deposits made by the player into their account will form a legally binding contract to these T&C’s.  Beda Leisure Limited reserve the right to refuse any entry to the lottery or to withhold any prize if it has reasonable grounds that these T&C’s have been breached.  All customer funds held with Beda Leisure Limited are deposited into a separate ring fenced account which protects the customer from the insolvency of Beda Leisure Limited.

1.6 Beda Leisure Limited may wish to alter these T&C’s periodically and we will notify players prior to any material changes being brought into effect. Beda Leisure Limited must lodge with the Gambling Commission a description of, and a copy of the rules, or amended rules, at least 28 days before any tickets are put on sale.

1.7 If any part of these T&C’s is deemed unlawful, void or for any reason unenforceable then that part alone shall be deemed to be omitted from the rest of the T&C’s and shall not affect the resolution and enforceability of the remaining provisions.

1.8 In these T&C’s the headings are used purely to assist the player and for convenience only, they shall not affect its interpretation.

1.9 These terms of use and conditions shall be governed by and constructed in accordance with English Law.  Disputes arising in connection with these T&C’s shall be subject to the exclusive jurisdiction of the English courts.

1.10 All jackpot amounts are estimates and dependant on ticket sales, please see section 4 in its entirety.

  • PLAYER ACCOUNT: CONDITIONS OF ENTRY

     2.1 All Players must be aged 16 years or over and complete the required registration form either via our website or using the LiveLotto® mobile based application.

     2.2 Players must be resident in England, Scotland, and Wales and be geographically present in one of these areas at the time of purchase to play LiveLotto®.

     2.3 Players must have the mental capacity to enter into a legal binding agreement with us and take responsibility for their own actions.

    2.4 Players must provide all information requested and it must be entirely accurate.  Any changes to this information after the registration process must be passed onto Beda Leisure Limited in writing and the player must change their settings within their account.

    2.5 Players are only permitted to register one account with LiveLotto®.  We reserve the right to immediately suspend and close down any duplicate accounts.

    2.6 Players must only use their own debit cards, credit cards and payment options.

     2.7 The player must take all precautions for their account passwords and log on details to ensure that only the registered player has access to their account.  Under no circumstances should a player allow anyone to use their account and the player registered bears all responsibility for any breach of the T&C’s through a failure of this policy.  Beda Leisure Ltd will not be accountable for any loss of money should the players device be compromised or stolen.  We always recommend that player devices are password protected.  The player must immediately inform us by email if they feel their account has been comprised, please email support@livelotto.co.uk with the title “Account Compromised”.

     2.8 As part of the account creation process Beda Leisure will utilise third party ID checking processes to ensure your age is verified.  As part of this process we will access third party databases to ensure that your details are correct.  We may also ask you on certain occasions to enter details from your passport or driving licence when you register to assist us in this process.  Please note if we cannot confirm your age and identity within 72 hours of opening your account we will void any transactions placed during that period and freeze your account.  If we cannot satisfactorily verify your information within a reasonable time period we reserve the right to withhold any funds until the verification process is completed.  On completion of our verification checks if you are found to be under the age of 16  your account will be immediately closed and we will maintain a record of the incident.  If an account has been opened using fraudulent information you will return to us on demand any winnings withdrawn from your account.

     2.9 No winnings will be paid to any players that have not passed the verification process.

     2.10 We reserve the right to recheck your account at any point in the future to ensure the details you provide are accurate and valid.  Beda Leisure will be entitled at any stage to demand further evidence that you are legally entitled to enter into a contract with us and that your country or residence and/or any other information is accurate at any time.

     2.11 All players must strictly abide by these T&C’s and the opening of your account confirms your acceptance of them.

     2.12 Any corporate body or limited company may choose to purchase and claim prizes in LiveLotto® with the exception of 2.14.

     2.13 A player in creating an account or trying to play LiveLotto® will forfeit his or her right to claim a prize if they have elected to self-exclusion and are under an active period of self-exclusion.

     2.14 Any player accepting a prize must not be an employee of Beda Leisure Limited, Itech labs or any associated IT consultant, contractor or supplier in present or past partnership with Beda Leisure.  The player must equally not be a spouse, civil partner, parent or dependant of the employee, consultant or supplier.

     2.15 Beda Leisure Limited maintains at all times absolute discretion on whether to accept any entry to the lottery and pay out of prizes should we feel there has been a breach of these T&C’s.  Its decision in the matter will be final and binding.

     2.16 Any player not using their account for a consecutive 365 days will have their account status changed to inactive.  Any inactive accounts will be liable to a monthly administration fee of £3 or 10% (whichever is greater) of the balance, should any balance remain on the account.  The inactive account charge will be processed within 24 hours of the account status being changed and thereafter on the last day of each subsequent month until the account reaches zero (£0.00).  At any time a player reactivating their account will suspend this process and we would recommend that if they no longer wish to play that they then initiate the closure procedure.

     2.17 We retain the right to close any inactive account upon the balance reaching zero.

     2.18 Beda Leisure will not be liable for any loss incurred by a player if such player has not complied with these T&C’s.

     2.19 A player wishing to close their LiveLotto® account should contact support@livelotto.co.uk stating their username and registered contact details.  All monies due will be transferred onto your chosen deposit payment method.  You may be contacted in future from our marketing team unless you have self-excluded with Beda Leisure Limited.

     2.20 Please note to meet legal compliance we will retain your account details, gambling activity and financial transactions for a period of no more than seven years.  After this date we will then delete all player account details from our database.

     2.21 A player may choose any username as long as it is deemed non-offending under English Law. LiveLotto® will not allow usernames that are created to market third party brands or products.

  • PLAYER DEPOSITS AND WITHDRAWALS

    PLAYER DEPOSITS AND WITHDRAWALS

    3.0 All funds deposited, winnings and withdrawals are in British Pounds Sterling.

    3.1 There is a minimum £5 on all deposits or withdrawals, the exception to this is if either you or Beda Leisure Limited are closing the account.  At this stage any monies owed in the account will be credited back to your account.

    3.2 Beda Leisure Limited reserve the right to amend these withdrawal, deposit and winner payment transaction type at any time.  Any alteration however will be notified via email to your registered account.

    3.3 Payments can be made by most debit and credit cards as displayed on our website.  We reserve the right at any time to alter this procedure.  All payments are processed by our payment gateway providers PayPoint Plc.  As such we will never store your card details on our servers.

    3.4 We do not charge for deposits made although you should note that some credit card companies may categorise gambling transactions as cash and as such may levy a fixed charge and/or interest charge from the date of the payment.  We do not charge for any withdrawals to debit or credit cards and it should be noted that the funds transferred will be returned to the account that was used for the deposit.

    3.5 All players agree not to make any charge-backs, reversals or otherwise cancel any deposits into your account.  In any event that this occurs the player agrees to compensate Beda Leisure Limited and this includes any additional expense incurred by us in the process of collecting your deposit.

    3.6 Your account must not be used as a bank account.  We will suspend any account where deposits are made and withdrawals occur without any gaming activity being undertaken.  All monies deposited with us will not attract interest.  The player agrees that any expense occurred as a direct result of this activity will leave them liable for any administration charges for our payment processing.

    3.7 No player will be allowed to deposit money into their e wallet account if their balance exceeds £2000.

    3.8 You are responsible to report your winnings and circumstances to the relevant tax or other authorities as required by your own personal circumstances.

    3.9 You can set a deposit limit in any one day, week or month, please see the settings within your account.  Please note that if trying to increase this level it will take a further 24 hours to increase your limit inline with our responsible gaming policy.

    3.10 If any sum is incorrectly credited to your account, you are obliged to notify us as soon as possible and we are entitled to recover such credits including any additional fees incurred in this recovery process.  If the money has been withdrawn from your account then you agree to reimburse upon our request.

    3.11 We are required by our licence to inform players about what happens to funds which we hold on account for you, and the extent to which funds are protected in the event of insolvency www.gamblingcommission.gov.uk/consumers/protection_of_customer_funds.aspx  The lottery monies managed by Beda Leisure Limited on behalf of the good causes are held in a separate ring-fenced bank accounts and are protected from insolvency. In the event that Beda Leisure Limited are declared insolvent, the lottery funds are protected and the creditors of Beda Leisure Limited will have no recourse to the lottery funds held on trust for the good causes and the players. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: high protection.

    Settlement

    3.12 Prizes will be paid by one of the two following procedures.

    3.13 Initially all money won will feature in your online balance.  It is then up to the player to reclaim the prize by our withdrawal procedure within the website or mobile app.  Jackpot winners over £1000 will be contacted by our accounts department using your registered details.

    3.14 All prizes not claimed within 180 days of the win date will be forfeited.

    3.15 All withdrawals up to £2000 will be paid directly onto the payment type used for depositing.

    3.16 Withdrawals over £2000 will be made via cheque within five working days.  Jackpot winners over this threshold will receive a notification to contact us directly at winners@livelotto.co.uk.

    3.17 We reserve the right that prizes over a certain amount can only be claimed in person and/or with supporting evidence of age, address and identity.

  • LIVELOTTO® : THE GAME

    LIVELOTTO®: THE GAME

     4.0 To play LiveLotto® the player account must have a balance of 10p or greater to purchase a ticket.  All jackpot amounts are estimates and based on full ticket sales.  The player can at any time review their etickets in the banking section (history) to find a full list of lotteries they have participated along with the outcome and statutory details that are required.

     4.1 The player selects which draw they wish to enter and the number of tickets for that draw.  There is a maximum number of tickets you can purchase for each draw.  You will never be allowed to purchase more tickets than the value of the jackpot prize inline with our money laundering policies.

     4.2 All LiveLotto® draws occur once the number of set tickets for that draw have been purchased in accordance with the prize table and draw date.  Players accept that there is a period of time from their purchase of ticket to the physical draw occurring and this depends on the jackpot that they wish to participate in.  The schedule for this and an example can be found in the prize structure table at the end of these terms and conditions, here.

     4.3 Players accept that these same day draws (£1, £5 and £10 jackpot), and the time taken for the draw to be made from the point of purchase, will change in relation to the various jackpot prize draws and at the times and days that they elect to play LiveLotto®.  It is important to note that for same day draws we have a cut off time where by any tickets purchased after this time will then occur in the following day.  Please see the prize structure table at the end of these Terms and Conditions, here.

    4.4 Once the draw date has been reached then all tickets for the draw, unless prevented or delayed by system failure or some other exceptional reason, the draw will occur.  Beda Leisure will select winners using an independently audited and approved random number generator.  If we are unable to run a particular LiveLotto® draw due to system failure or some other exceptional reason, we will initiate the draw as soon as operationally possible.  The Players are locked into the event and will not be allowed to cancel their tickets once placed unless we cancel your account due to fraudulent activity on your part.

    4.5 Where prize draws contain more than one winner it should be noted that the highest Jackpot prize is chosen first by the random number generator (“RNG”) and then continues to select winners at random until all prizes have been awarded with the lowest prize being selected last.

    4.6 Whilst Beda Leisure Limited have utilised next generation software to bring the player a graphical interface that is fun to play it should be noted the game sequence that graphically depicts the ball selection within the game has no bearing whatsoever on the predetermined winning entries.  It is purely a simulation.  The winners are chosen by the RNG prior to this event being shown and the ball selection is purely a graphical representation of this event.  The spotlight will always select the winners that have already been chosen by the RNG from the secure database of entries.

    4.7 LiveLotto® is limited to various hardware restrictions of the consumers device.  In the interest of being available to play for most players we have had to limit certain various levels of display.  We reserve the right at any point to further alter and tailor the winner depiction sequence if we believe it enhances customer experience however any changes would be in accordance with the UK Gambling Commission and our external testing auditors.

    4.8 The viewing window of your device will not be able to see the full 3D box and as such you may not always be able to see your ball as it bounces around the screen.  Equally where players purchase large number of tickets this cannot be simulated with current levels of technology and what you will see is a representation of the number of balls you have selected not the physical number of entries you have made into the draw on the secure database.

    4.9 At no time does the graphical representation of the player’s ball entries affect your chances of winning.  If you purchase x number of tickets, then exactly that number of tickets will be reserved on the secure database as entries which may or may not be selected by the RNG.

    4.10 LiveLotto® uses a prize and ticket entry structure.  Please see our separate table here.  We may at times alter the prize structure if all the tickets haven’t been sold for a specific draw, all jackpots are estimates and dependant on ticket sales. Players will be notified prior to any alterations made.

    4.11 Only one prize may be claimed in respect of each entry made into the LiveLotto® draw.

     4.12 Beda Leisure Limited reserves the right to change the prize and matrix structure at any time depending on player uptake however all changes would be communicated to the players, the society that the lottery belongs to and the UK Gambling Commission.  All jackpots are estimates.  Beda Leisure Limited also reserves the right to alter the prize and ticket structure at any time at its absolute discretion where it is required to do so by law, regulation or the instruction of the UK Gambling Commission.     4.13 Beda Leisure Limited does not anticipate not selling all tickets for a specific draw in the timeframe specified.  However, if all tickets for a specific draw have not been sold within the timeframe specified on the prize matrix, we would still close the lottery draw and permit no more players to purchase tickets for that specific draw.   In such circumstances that all tickets haven’t quite been sold for a specific society lottery then the jackpot prize and lottery proceeds would be devolved under our existing framework between our legal commitment to the society that the lottery belongs to, of which they receive a minimum of 20% of all tickets sales as per section 99 of the UK Gambling Act 2005, the prize fund (65.5% of ticket sales) and our operating costs.  We would notify players of the new jackpot and prize structure prior to the draw being made.  The winning ticket(s) would then be selected using the random number generator.  The lottery sales would always maintain the same prize percentage ratio between the society, prize fund and Beda Leisure Limited, as per above.

    In exceptional circumstances when a draw does not receive customer support we may elect to cancel a specific draw in the interest of good customer service.  Players will not be at a disadvantage and in this exceptional case players will be notified by email and the ticket purchase amounts will be returned to their ewallet account within 72 hours.

     4.14 All jackpot prize estimates are based on 100% of ticket sales for that specific draw.

    4.15 No prize will be settled on accounts that have failed the full terms and conditions of this document.

     4.16 By claiming and accepting a prize the player agrees to publicity which will be carried out at the sole discretion of the company.

  • COMPLAINTS AND DISPUTES PROCEDURE

    COMPLAINTS AND DISPUTES PROCEDURE

    5.0 If you are unhappy about any aspect of the gambling service we provide then we would request that you follow the four-stage procedure set out below.

     Stage 1: Complaint

    5.1 In the event of any dissatisfaction with any aspect of LiveLotto® we would request that you contact our dedicated complaints department here “contact us”, or by complaints@livelotto.co.uk.  Please note we can also be contacted directly at our Head Office postal address.  These must be clearly addressed to the Complaints Department.

    5.2 As part of this process we will look to acknowledge receipt of the complaint and provide resolution within 5 working days of receipt of the complaint.

    Stage 2: Complaint Investigation

    5.3 If the complaint cannot be easily resolved by Beda Leisure the complaint will be escalated to a Director of the company within 5 working days.  You will be notified that a simple resolution cannot be made and that we have escalated your complaint to level within the organisation.

    Stage 3: Complaint Director Review & Outcome

     5.4 A Director of the company will then take a full review of the incident.  This process will be fully documented with yourself and he or she will seek to bring a resolution to the complaint within 5 working days.

    Stage 4: Disputes

    5.5 If a complaint is not resolved to the player’s satisfaction after exhausting Beda Leisure Limited’s complaints procedure then we would ask that you contact the Independent Betting Adjudicatory Service, IBAS.   They are completely external to Beda Leisure Limited and we have appointed them to ensure all players have an impartial adjudicator to any Gambling dispute that may occur.  They can be contacted directly on 020 7347 5883 or by emailing adjudication@ibas-uk.co.uk

    5.6 There is no charge associated with this process and for the consultation with IBAS.

    5.7 IBAS will not consider any complaints or disputes that have not gone though this complaints and disputes process or any other content that doesn’t purely relate to the outcome of your ticket.

    5.8 We would advise and request that you keep a detailed file and photocopy any documentation that you send to IBAS or us.  If any documentation is required to be returned then we would request a self addressed envelope be remitted at the same time with a note to request that we return the documentation.  We also note as part of this process we retain the right to copy all documentation sent into us for our records.  We will not be held responsible for any loss of documentation sent to IBAS and would highlight that to ensure mail is sent recorded delivery if important documents are to be sent through the post.

     

  • SELF EXCLUSION
    • SOCIAL RESPONSIBILITY, PLAYER LIMITS, TIME OUTS AND SELF EXCLUSION

    6.0 Beda Leisure Limited take problem gambling very seriously and seek a proactive approach in assisting our customers with tracking their gambling spending patterns, providing guidance when required and providing them with easy and accessible systems that allow an immediate stop to their gambling activity.

    6.1 Beda Leisure Limited highlight on all marketing and points of sale that under age gambling is illegal and that we utilise third party software to ensure that players are ages 16 years or older.

    6.2 Beda Leisure Limited ensure that all marketing material released into the public domain abides by the Gambling Commissions Licence and Codes of Practice and the Gambling Act 2005.

    Not everyone realises they have a problem until it becomes a controlling and destructive force in day to day life.  However those around you just might.  If you answer yes to any of the above questions you may have a gambling problem and we recommend that you take immediate and positive steps today to help yourself or your loved one control and beat gambling addiction.

    6.5 We want players to enjoy the interaction and experience that LiveLotto® and to remember that at all times they must ensure they gamble responsibly and set player limits. However any player that feels they are losing the ability to control their play we would strongly advise that they seek an immediate stop to the gambling activity either via a time out period or complete self-exclusion and contact the above helplines provided.

    Player Limits

    6.6 All players will have easy access to set player limits within their account, which ensures that within any 24 hour, weekly or monthly period a player cannot spend more than their limit even if they have further funds available.  Please note, any increase to these limits will take a further 24 hours to implement to protect against gambling addiction.  Decreasing player limits have an immediate effect.  Simply go to settings and you will be led through the quick and simple process.

    Player Time Outs

    6.7 If you ever feel frustrated or feel like you have to carry on playing to win we recommend that you take an immediate cool down on your gambling activity.   Player time outs allow a player to select how long they wish to suspend themselves from play.  Simply fill out the player time out form in game and we will suspend your account.  Player’s can choose from 24 hours, one week, one month or any time period up to and including 6 weeks.

    Self Exclusion

     6.8 Beda Leisure Limited offer an immediate and robust self-exclusion period.  At any time a player can elect to self-exclude themselves from LiveLotto® by emailing management@livelotto.co.uk or by utilising the self-exclusion option in either the mobile application or the website.  We would recommend that you contact Gamcare (here) or Gamble responsibly (here) for further advice on Gambling Addiction.

    6.9 All monies held by Beda Leisure Limited upon receiving the self-exclusion request will be returned to the player and the account will be suspended with immediate effect.  There will be no recall of this email and we will consider your instruction final.  Any tickets purchased in draws after this email, or tickets already placed for future draws will be forfeited with immediate effect irrespective of if they win.

    6.10 Players can choose the length of the exclusion period however the minimum period is six months.  The player can request the period to be extended up to and including twelve months.  During this time period the player will not be permitted to access any section of their online account held with Beda Leisure Limited or to purchase tickets for any subsequent draws.

    6.11 Please note that we will not contact you after the period of self exclusion finishes and your contact details and email address will be removed from our active marketing database.  Players wanting to reactivate their account after the end of the self exclusion period must contact us on 0330 123 5993 and we will then impose a further 7 days cooling off period so that the player can reassess their intentions prior to being allowed to gamble.

    6.12 If an account is reactivated a player can elect to self-exclude at any time again in the future.

    6.13 Your account will not be deleted if you have chosen to self exclude as the account must be kept as a record under the Gambling Act 2005.  We are also required to keep player details for no more than 7 years as per the T&C’s specified in 2.20.

    6.14 Lastly self-exclusion requires the joint commitment of both the player and Beda Leisure Limited and whilst we will undertake dedicated steps to ensure you can no longer access our product we highlight that you must not attempt to open new accounts and you accept that we will have no responsibility or liability whatsoever if you continue to gamble by means of using a different name or address.

     7.0 Beda Leisure Limited take seriously the risk imposed by organised crime and are determined to ensure that LiveLotto® does not provide a forum for money laundering activities to occur.  All of our gambling services provided are structured to work within the Proceeds of Crime Act 2002 and at all times Beda Leisure Limited will operate within this legal framework.

    7.1 We aim through a mixture of prevention, detection and deterrence to ensure that any fraudulent or suspicious player activity is highlighted internally and then reported to the National Crime Agency.  This transfer of information will include all registered details and player locations for any suspicious activity that we detect.

    7.2 Players must ensure that the app is used only for fun and fair gambling and must not attempt to utilise the product with a view to exchange money or seek to gamble with any revenues that have criminal or unlawful origins.

    7.3 All customers will have to undertake an ID check prior to being allowed to participate and provide credit to an account which will be conducted by our agreed external partner.

    7.4 Beda Leisure Limited have a separate Anti Money Laundering and Terrorism policy.

     8.0 All mobile application and website design, which includes graphics, txts, sound, music, vibration patterns on electronic devices, photographs, video and the arrangement of such material, software utilised including all source code and any other material forming part of our service are subject to copyright and other proprietary rights which are either owned by Beda Leisure or used under licence from third party rights owners.

    8.1 You may print and download information purely for your own personal, non-commercial use from either the website or app however on the basis that nothing is altered from its original form and no copyright notices, patent pending notifications or corporate logos are obscured or removed from the images on the website or application in anyway.  No graphics are too be used separately and no manipulation of our original information is permitted in order to relay a separate message of the player.

    8.4 No links to Beda Leisure Limited LiveLotto® websites are to be permitted to be displayed without our prior written permission.  The player agrees not to display or use such logos, designs, trade mark and other endemic brand features in any manner whatsoever.     8.5 If any breach occurs of these terms we reserve the right at any stage to terminate your permission to use the mobile application or website and you must immediately return or destroy any downloaded or printed extracts that you have made.

    10.2 Players must not be aggressive or harass any other person and will not say or post any material that swears, threatens or intimidates other users or employees of Beda Leisure Limited or any of its third party suppliers.

  • THIRD PARTY SOFTWARE

    THIRD PARTY SOFTWARE

     11.0 In order for you to play LiveLotto® you will be required to download and install software supplies by third parties onto your access devices.  As part of this process you may be required to enter into a separate agreement with the owner of such software and abide by their separate terms and conditions.

     11.1 It is the player’s responsibility to ensure that any software downloaded and installed onto your access device is fully compatible with your hardware. The player will be fully responsible for the installation of all software and Beda Leisure Limited will not be liable for any damage this may cause either through contamination or corruption of hardware on your access device, compatibility issues arising with existing software or any loss of data occurred as a result of this process.

     IT FAILURE

     12.1 Beda Leisure Limited will take all reasonable steps to ensure that the software and hardware used to provide LiveLotto® provide a stable platform for the player.  In exceptional circumstances beyond our operational area of control we may experience an IT failure which may cause an interruption to normal services.  We will endeavour to ensure that we restart the game from exactly the same position however if this is not possible or detrimental to the player or other users we may be forced to cancel without prior notice a specific draw.

     12.2 Please note that to play LiveLotto® you will need to retain a connection to our data servers at all times.  This may not be possible for some player’s dependent upon their location within the UK cellular data service.  We cannot be held accountable or liable for a loss of service from your internet service provider or cellular data provider.

  • LIMIT OF LIABILITY

    13.0 Nothing in these Terms and Conditions will operate so as to exclude any liability on Beda Leisure Limited in respect of death, personal injury caused by our negligence or fraud (including fraudulent misrepresentation).

    13.1 Subject to clause 13.0 except in a specific case of manifest error by Beda Leisure Limited we accept no responsibility or liability for any consequences that are to have occurred through a players use of the website or mobile application or any services we provide.  This will include loss of revenue, contract, profits, business interruption or anticipated savings or loss of date, consequential losses, goodwill or reputation.

    13.2 Beda Leisure Limited cannot guarantee that the use of the mobile application, website or live transmission of data will be uninterrupted, timely and/or error-free

    13.3 Beda Leisure Limited’s liability which relates to a ticket entry, will be limited to the total value of tickets purchased for that draw.  Any liability that relates to a misapplication of funds from your account, the liability limit will be the amount of money in your account that has been misplaced by Beda Leisure Limited.  In respect to any other liability of Beda Leisure Limited then the limit will be £1000.

    13.4 Beda Leisure will not be responsible for any websites why may be visited by links provided on our online service.  Visits external to other websites are conducted entirely at the Players own risks.

    13.5 Beda Leisure reserves the right to exclude any player from LiveLotto® in the event that we believe in our sole discretion that the player may be using technology to gain an unfair advantage over other players in LiveLotto® draws.

     BREACH OF TERMS & CONDITIONS

     14.0 You agree to fully indemnify us, defend and hold us and our associated companies, affiliates, officers, directors, agents and employees harmless from any liabilities, costs, expenses, claims, losses, damages or demands (including legal fees), however caused, that may arise, whether or not reasonably foreseeable, as a result of or in connection with your breach of these T&C’s or your use, or any unauthorized or unlawful use of your account.

    14.1 All amounts due under the terms of use shall be paid by you to us in full without any set-off, counterclaim, deduction or withholding (other than any deduction or withholding of tax as required by law)

     14.2 In addition to the beaches referenced throughout these terms and conditions Beda Leisure Limited retain the sole right to suspend and close your account at its sole discretion and to restrict your passcode and log on details at any time.  We will communicate via your registered email address to this effect.
